Attorney Examiner Entry directing that Ohio Edison’s motion to compel be granted, that Ohio Edison’s request for dismissal of the complaint be denied at this time, and that Ohio Edison’s motion to continue the July 29, 2014 hearing date in this case be granted. The Complainant also is directed to participate in a deposition arranged by Ohio Edison in this matter no later than August 22, 2014, and provide the Company with full and complete answers to the Company’s questions at the deposition; otherwise, no hearing in this matter shall be rescheduled and, instead, the Commission would expect to consider a subsequent motion, if one is submitted by the Company, seeking a dismissal of this case for lack of sufficient prosecution by the Complainant. Further, the Complainant may, as an alternative to providing the information required at deposition, seek to have this case dismissed without prejudice at any time up to the August 22, 2014 deadline set forth in this Entry, but his ability to bring the same issues in a future case shall be subject to the contingencies expressed in Finding (10) of this Entry; electronically filed by Vesta R Miller on behalf of Kerry K.
