Entry ordering that Spitzer's motion to consolidate is granted, subject to restrictions. Spitzer shall be bound by the procedural schedule established by examiner entry dated August 17,2004. NOPEC, Green Mountain and Ohio Edison shall file and serve answers within 10 days following service of Spitzer complaint in 04-1439. Spitzer shall respond to discovery requests of respondents that are served prior to Oct. 8, 2004 by Oct. 18, 2004 and that the evidentiary hearing remains scheduled Oct. 26, 2004 at 10:00 AM in hearing room 11-F in the offices of the Commission. |
