Opinion & Order that Wheeling's motion to dismiss the complaint be denied; that UTU's complaint is granted; that, on or before April 16, 2002, Wheeling file in this case and notify the chief of the transportation division a status report describing the nature of its operations on the track in the area; that, in the event, Wheeling is operating trains, or allowing the operation of trains by any other entity on Wheeling's track located between mileposts 5.1 and 6.0, Wheeling shall, on or before May 13, 2002, remove all debris as set forth in this order. |
