07/23/2002 | Entry ordering that at least 45 days prior to the date of enactment of a public way ordinance by a municipal corporation, the municipal corporation shall file with the PUCO a notice that the ordinance is being considered; the Commission finds that new case purpose codes should be established for the filing of a notice by a municipal corporation; the new purpose code to be used by a municipal corporation will be "PWN" which stands for "Public Way Notification"; that any public utility seeking to appeal a public way fee shall do so by filing a complaint with the Commission not later than 30 days after the date the public utility first becomes subject to the ordinance; the complaint shall be filed under the new case purpose code "PWC" which stands for "Public Way Complaint"; a public utility subject to the rate-making jurisdiction of the Commission may file an application for timely and full recovery of a public way fee, to be filed under the new case purpose code "PWT" which stands for "Public Way Tariff"; a public utility may file an application for accounting authority to classify the costs associated with a public way fee as a regulatory asset for the purpose of recovering that cost, which should be filed under the new case purpose code "PWR" which stands for "Public Way Regulatory Asset". | 2 |
