Feel free to approach one of us 23 after the completion of this evening's hearing if you 24 have any such questions. 25 At this time we will take the appearances 5 1 on behalf of the parties. 2 On behalf of the Applicant. 3 MR. SCHMIDT: Thank you, your Honor. 4 Robert Schmidt and Emily Taylor of the law firm 5 Porter Wright Morris & Arthur, 41 South High Street, 6 Columbus, Ohio, on behalf of American Transmission 7 Systems, Incorporated. 8 ALJ AGRANOFF: Thank you. 9 Are there any other entities that are 10 present that would like to make an appearance at this 11 point in time? 12 The subject of this evening's public 13 hearing is the application filed with the Board on 14 January 13th, 2017. Specifically, in this case, ATSI 15 seeks to construct a new 138 kilovolt or kV 16 transmission line in Moorefield Township in Clark 17 County, Ohio. The new transmission line will connect 18 the East Springfield-Tangy 138 kV transmission line 19 to the Broadview Substation. 20 According to the application, the purpose 21 of the proposed project is to improve and expand the 22 transmission service to the Clark County region, and 23 to improve electric service reliability in western 24 Ohio by providing increased redundancy and operating 25 flexibility. 6 1 Currently, the electric transmission 2 service in the immediate project area is provided by 3 two 69 kV subtransmission lines that extend north and 4 south from the Broadview Substation, with residences 5 and local businesses being served by smaller 6 distribution circuits. 7 I would note that the adjudicatory 8 hearing in the proceeding is scheduled for 10:00 a.m. 9 on June 27th, 2017, at the offices of the Ohio Power 10 Siting Board in Columbus. 11 The applicant plans an in-service date 12 for the proposed project of November 2018. 13 In this case the company has proposed a 14 preferred and an alternate route. The purpose of 15 this evening's public hearing is to receive comments 16 from the public regarding ATSI's application in this 17 case. It is not intended to be a question and answer 18 session, but, instead, is your opportunity to let the 19 Board know what you think about the proposals set 20 forth in the application and your preference relative 21 to the proposed preferred and alternate routes. 22 I would also note that the Board's staff 23 filed its Report of Investigation in this case on 24 May 30th, 2017. This is simply a recommendation of 25 the Board's staff and does not necessarily reflect 7 1 what the Board's final determination will be. 2 The Board appreciates your participation 3 in tonight's hearing, and we want everybody who is 4 interested to have the opportunity to provide their 5 testimony. 6 I will call your name as it appears on 7 the sign-up sheet. FLAX: I'm here on behalf of my 8 clients, Doug and Delores Hurst, and Scott and Rick 9 Haerr. The Haerr and Hurst families own and/or farm 10 approximately 500 acres along what's been identified 11 as FirstEnergy's preferred route. 12 The proposed transmission line is going 13 to significantly chop up my clients' properties, make 14 them less useable and less valuable for agriculture, 15 less valuable for development at some point in the 16 future. We have -- we have -- we have a lot of 17 housing around this -- around this area. These -- 18 these properties have not been developed at this 19 time; certainly have development potential. 20 In terms of impact on agriculture. My 21 clients, the Haerrs, have plans to install 22 center-pivot irrigation on their farms. They, in 23 fact, have center-pivot irrigation on other farms. 24 This is going to make it almost impossible to use a 25 center-pivot on their farms once these -- once this 10 1 is in place. 2 We would request that the -- that the 3 application be disapproved or, alternatively, that a 4 different route be selected that does not impact my 5 clients' properties. 6 I noted that the application indicates 7 that the purpose of this is to meet anticipated 8 growth in Clark County -- in the Clark County area 9 for the near future. I'm -- I'm under the impression 10 that this is related to -- to growth at Navistar. I 11 know that last week they -- they announced the 12 layoffs of 80 employees. 13 So I don't know whether the -- whether 14 the growth that was initially expected or that was 15 anticipated as a need for this project continues to 16 exist. And on that basis, and for the other reasons 17 I've stated, we'd request that the application be 18 denied. 19 ALJ AGRANOFF: Questions on behalf of the 20 company? 21 MR. SCHMIDT: No. Thank you. 22 MR. FLAX: Thank you. 23 ALJ AGRANOFF: If I could ask some 24 clarifying questions. 25 MR. FLAX: Oh, sure. 11 1 ALJ AGRANOFF: With respect to your 2 client, what is the address for their property? 3 MR. FLAX: Well, I'm here with -- I'm 4 here with Scott Haerr and Doug Hurst today, so I'll 5 just defer to them. Scott -- Scott, what's your 6 business address? 7 MR. FLAX: This would -- this would go to 22 -- to the preferred route. The preferred route is -- 23 is the one that crosses my clients' properties; the 24 one that would have the most adverse impact on my 25 clients' properties. 12 1 At this point, I don't -- I don't think 2 we have a position with respect to the -- we're not 3 opposing the alternate route. 4 MR. DAVIS: I'm representing Lou 15 Clarkston, because actually I thought this was going 16 to be one of the science fairs again, instead of a 17 true meeting, and I commend you guys for having a 18 true meeting where people can ask questions. 19 It's going to be -- the preferred route 20 is going to be a definite impact to the Clarkston 21 family. It's splitting two of their farm fields 22 right down the middle. 23 We have worked with some of the 24 representatives of FirstEnergy, trying to come up 25 with an alternative, possibly going straight down, 14 1 following Route 4, and that seems like it's not 2 coming to light. But for the Clarkston family that 3 would be the preferred direction. 4 I was willing to give up part of my 5 ground and follow an open ditch so that it would be 6 less impactful to the Clarkstons and other people in 7 the neighborhood. So that's basically all I have. 8 ALJ AGRANOFF: Okay. And are you an 9 attorney? 10 MR. DAVIS: No. I'm the farmer of 11 Mrs. Clarkston's ground. And it impacts my ground 12 also; it's crossing my property also. 13 ALJ AGRANOFF: And with respect to your 14 personal perspective and thoughts? 15 MR. DAVIS: The preferred route -- either 16 one was not going to be that impactful to me, but if 17 we came straight down Route 4 and didn't cut 18 diagonally across me, I was going to work with 19 FirstEnergy to give them an alternative route to go, 20 to be less impactful for the whole Clarkston farm. 21 You're splitting over 106 acres and two farms -- two 22 fields and making four fields out of it. So I was, 23 as being the operator on the farm, I was willing to 24 work with them. 25 ALJ AGRANOFF: So you currently farm for 15 1 the Clarkstons? 2 MR. DAVIS: Correct. 3 ALJ AGRANOFF: Okay. So when you were 4 speaking about your willingness to do something, you 5 were speaking with respect to the Clarkstons' 6 property? 7 MR. DAVIS: No, to my property. 8 ALJ AGRANOFF: Oh. 9 MR. DAVIS: I was giving up property, 10 additional property, to give an alternate route. 11 ALJ AGRANOFF: So you have land that's 12 adjacent to the Clarkstons? 13 MR. DAVIS: Right beside it, yes, just to 14 the east of it. 15 ALJ AGRANOFF: So you farm yours plus 16 theirs. 17 MR. DAVIS: Correct. 18 ALJ AGRANOFF: Okay. Any questions from 19 the company? 20 MR. SCHMIDT: No, your Honor. 21 ALJ AGRANOFF: One other question. With 22 respect to the alternate route, what were your 23 thoughts on that? 24 MR. DAVIS: To bring it on -- on down 25 Route 4, where there's already existing -- 16 1 MR. HAERR: The proposed alternate route 2 I think he's talking about. 3 MR. DAVIS: Yeah, yeah. 4 ALJ AGRANOFF: The proposed alternate 5 route. 6 MR. DAVIS: Yes. I don't have -- haven't 7 got that much interest in it -- or information on it. 8 I -- that -- I believe the alternate route was going 9 down Route 4. 10 ALJ AGRANOFF: If I showed you the map 11 that was part of the application, and the alternate 12 route is the yellow. 13 MR. DAVIS: I think I would prefer the 14 alternate route in that I believe -- not seeing the 15 exact street names -- that would bring it down 16 Route 4. As it's supposed to go down, it will split 17 another farm, I was willing to work with the adjacent 18 farm to bring it straight over along my ditch line. 19 And I mean Mr. Beech, I don't believe he's here, I've 20 worked with him, and trying to make the best of a bad 21 situation as far as we're concerned. 22 ALJ AGRANOFF: All right. 23 MR. DAVIS: Thank you. 24 ALJ AGRANOFF: Thank you. 25 Is there another individual that would 17 1 like to testify? 2 MS. WILLIAMS: Some of you may be 17 familiar with it. There's two ponds on the property 18 where it corners into Mumper Road. 19 We're on the alternate route. I 20 understand the concerns for the farmers, but if they 21 go the preferred route or even part of the alternate 22 route, it would be -- those poles would be placed in 23 the farmers' what I call "back 40." They can go out 24 their back door, they can go out their front door, 25 and those poles aren't -- are almost not in sight. 18 1 But because of the way my property is 2 situated and is perpendicular to Route 4, when I walk 3 out my front door, that's my front yard, that's where 4 we entertain, and all the poles will be smacking me 5 in the face. They're going to take down the trees of 6 which many of the trees we put there to try to block 7 Route 4. So now we will be completely "open spanse" 8 to Route 4 and entertaining with the poles in front 9 of our face. 10 ALJ AGRANOFF: Thank you. 11 MR. EHNIE: The property that I'm 10 concerned about is property that I own at the corner 11 of Prairie Road and Route 4, I think it would be the 12 southeast corner, of approximately 40 acres. I'm 13 opposed to the primary route due to the fact that it 14 would directly impact the farming operation on the 15 farm. The farm consists of approximately 40 acres 16 and it would affect that greatly because it would go 17 right through the middle of the farm. It would 18 significantly affect the values of the farmland and 19 then for any future development. 20 It is preferred if -- the preferred, as I 21 said before, is opposed. The alternate plan I would 22 not disagree with and that would be satisfactory to 23 me. 24 As it has been explained to me earlier by 25 Jason Hill, the lead right of way agent, that after a 20 1 couple of sessions with him it was determined that he 2 thought that the alternate route would be used and -- 3 and we sat and talked about that. He also gave me a 4 map of what was drawn for the alternate route, going 5 along our property, along Route 4. This is -- this 6 is the -- this is the route, alternate route that I 7 approve of. 8 And the only other thing I can say is 9 it -- it would make it hard, without some 10 understanding of which way the company was going to 11 go, in order for me to negotiate the property and the 12 take. So that's what I have to say as far as I'm 13 concerned about the property. 14 ALJ AGRANOFF: If I could ask just one 15 clarifying question. The individual you spoke of who 16 you said had a conversation with you -- 17 MR. EHNIE: Yes. 18 ALJ AGRANOFF: -- you said was the right 19 of way -- 20 MR. EHNIE: Well, he explained the -- he 21 explained the primary right of way and the alternate 22 right of way. When he first come out it was -- it 23 was we had two ways to go; the primary and the 24 alternate. He didn't know which way it was going. 25 But he indicated to me, the second time I 21 1 met with him, that the alternate route, to appease 2 the property owners along that area, was the way it 3 may well go. 4 ALJ AGRANOFF: Was this individual an 5 employee of the applicant? 6 MR. EHNIE: I can't tell you that. 7 He's -- he's with Property ROW; Acquisition with 8 Integrity. And that's all I can tell you. He's from 9 Zanesville. 10 ALJ AGRANOFF: You don't know whether he 11 was employed by the applicant in this case? 12 MR. EHNIE: You're talking about 13 American -- 14 ALJ AGRANOFF: Yes. 15 MR. EHNIE: No, I just -- I guess I 16 assumed he was. I'm certain at this point he did 17 show me identification to that effect. 18 ALJ AGRANOFF: Any questions from the 19 company? 20 MR. SCHMIDT: Yeah. 21 - - - 22 CROSS-EXAMINATION 23 By Mr. Schmidt: 24 Q. Just a couple of questions and I just 25 want to make sure that we get this clear. The name 22 1 of the right of way expert or the right of way agent 2 was Jason? 3 A. Yes. 4 Q. Do you have his card? 5 A. Yeah. 6 Q. Can I see that real quick? 7 A. Sure. 8 Q. Oh, Jason Hill, okay. 9 MR. SCHMIDT: Just so you know, your 10 Honor, Jason Hill is a contractor for the company on 11 right of way acquisition. 12 Q. Do you recall when you had these 13 conversations with Mr. Hill? And the reason I ask is 14 when we're at this hearing now and with the Staff 15 Report and with the application, we specifically 16 refer to a "preferred" and "alternate" route. And 17 I'm curious if he discussed with you two possible 18 alignments on your property before that determination 19 had been made. 20 My question is basically when you're 21 saying "alternate," is he refer -- are you referring 22 to an alternate alignment on this property or did you 23 understand it to be the alternate that was proposed 24 in the application? 25 A. I was understanding it to be the 23 1 alternate that was proposed on that. 2 Q. And you're testifying today that he told 3 you that the alternate was likely to be the selected 4 route? 5 A. The way I remember it is that at the 6 second time we met, he indicated that he had talked 7 with other property owners in that area and it was a 8 majority of them apparently wanted the alternate 9 route. He thought that if they could work it out 10 with the land owners that was the direction they were 11 going to go. 12 Q. Okay. So at the time he was discussing 13 with you acquiring right of way on your property -- 14 A. Yes. 15 Q. -- he basically said that there are two 16 different ways that this route could go; that it 17 really hadn't been decided which way they were going 18 to go. 19 A. That's true. 20 Q. Not which way it was going to go, but 21 what was going to be the recommended preferred route 22 as opposed to the recommended alternate route. 23 A. Yes. That's -- that's what he was 24 saying, was telling me. 25 Q. And just to make sure that I get this 24 1 clear: At this point only the preferred route 2 impacts your property? 3 A. No. 4 Q. Okay. I didn't get that. So both of 5 them. 6 A. Both of them impact my property, but one 7 impacts it to a much greater extent than the other. 8 Q. And the greater impact is what is 9 identified as the preferred -- 10 A. The primary. 11 Q. -- the preferred route. 12 A. Yes, excuse me, preferred. 13 Q. I get it confused, too. Thanks. 14 MR. SCHMIDT: No further questions. 15 ALJ AGRANOFF: I just had one additional 16 clarifying question and that would be: Do you 17 remember the approximate time frame of the 18 conversation that you had with the individual -- 19 MR. EHNIE: The right of way agent? 20 ALJ AGRANOFF: Yes. 21 MR. EHNIE: Let's see. We're in May 22 now -- we're in June now. Best I can recollect it's 23 sometime in April. I can't give you any exact dates 24 on it. I might be able to do that if I was to look 25 at my calendar and see when I met with him, but I 25 1 don't have that with me. 2 ALJ AGRANOFF: But it was certainly 3 subsequent to the filing of the application as it 4 currently stands before the Power Siting Board? 5 MR. EHNIE: Before it was? 6 ALJ AGRANOFF: That conversation took 7 place subsequent to the filing of this application. 8 MR. EHNIE: I'm not sure about that. 9 When was that filed? 10 ALJ AGRANOFF: January of '17. 11 MR. EHNIE: No, it was after January of 12 '17, yes.
