Finding and order approving additional commitments made by applicants in comments with subject to modifications and conditions set forth in this finding; that CG&E's application for authority to modify its current accounting procedures to defer costs be denied; that the affiliate agreements by and between CG&E and its affiliates, as set forth in the application and in the comments filed on December 1, 2005 be approved; that the motions for intervention be denied; that the approvals set forth in this finding and order do not constitute state action for the purpose of antitrust laws. It is not the Commission intent to insulate CG&E from the provision of any state or federal laws which prohibit the restraint of free trade; that the proposed tariff of CG&E are approved; that the proposed tariffs be effective January 1, 2006, on a services-rendered basis; that CG&E is authorized to file tariffs consistent with this finding and order and to update its tariff previously filed electronically, which shall be completed prior to January 1, 2006. |
