Finding and Order, ordered; that the application filed by Ohio Edison Company, The Cleveland Electric Illuminating Company and The Toledo Edison for approval of the contracts entered into between FirstEnergy Service Company and First Communications, LLC is granted; that all future transactions between the parties, including all modifications, assignments, transfers or terminations of the contracts approved in this case, must be submitted to the Commission for prior review; that the motion to intervene filed in this proceeding by Ohio Consumers' Counsel is denied; that approval of the contracts as set forth in Finding (8) does not constitute state action for the purposes of antitrust laws. |
