Entry ordering that the motions to intervene filed by OEC, ELPC, and OCC be granted; in accordance with finding (5), the motion pro hac vice to admit Robert Kelter be granted; in accordance with finding (8), Duke's request for waiver of Rule 4901:l-40-04(D)(l), O.A.C, be granted; in accordance with finding (9), Duke's proposal to substitute 80 Pennsylvania SRECs from Ohio-certified facilities in place of the 80 in-state SRECs be denied; in accordance with finding (12), Duke's request that the Commission make a force majeure determination regarding its 2009 in-state SER benchmark and reduce the aggregate SER benchmark to the level of SRECs actually obtained by Duke be granted, contingent upon Duke meeting a revised 2010 SER benchmark, which shall be increased to include the shortfall for the 2009 SER benchmark. |
